Terms and Conditions of Business

  1. The following terms and conditions of business apply between Media Gang Limited ("the Company") and its customer ("the Customer") except to the extent that they have been varied or supplemented in writing from the Company to the Customer.

  2. The Company shall provide the Customer with such advertising for such period(s) and in such localities as is agreed in writing between the Company and the Customer. Whilst the Company will use all reasonable endeavours not to do so, the Company may deviate from any agreed locations when placing its adverts.

  3. Unless commissioning the Company to design and produce adverts, the Customer shall provide all artwork to be used in the creation of the stencils used in the campaign. Such materials shall be of dimensions specified by the Company at least seven days before the agreed date upon which the contract shall commence.

  4. The price payable by the Customer to the Company for the Company's services shall be in accordance with the Company's quoted price.

  5. In the absence of negligence on the part of the Company, the Company shall not be liable for any loss arising in connection with any contract between the Company and the Customer. The Company shall have no liability in respect of any term or condition implied by statute.

  6. The Company reserves the right to refuse to display any advertisement without giving any reason. Advertising material will not be accepted if, in the opinion of the Company, the advertising material fails to conform with the British Code of Advertising Practice, or is likely to offend any particular members or sectors of the public.

  7. The Customer will indemnify the Company against any loss or liability which the Company may incur as a result of any costs, claims, expenses or proceedings in relation to any advertising material for which the Company's services have been contracted by the Customer.

  8. The Company shall not be liable for any loss or damage suffered by the Customer as a result of any failure by the Company to provide any services in accordance with this agreement with the Customer, if such failure is in any way caused by war, strike, lockout, sit-in, trade dispute, accident or breakdown to plants or machinery, natural catastrophe including adverse weather conditions, or any other cause whatsoever beyond the Company's control.

  9. Cancellation Policy:

    1. The Client may not cancel a booking unless the cancellation occurs before the commencement of the booking and with written notice to Media Gang.

    2. Cancellation after confirmation and with more than 1 weeks’ notice = 35% of the total cost, plus any costs already paid to third party suppliers

    3. Cancellation with less than 1 weeks’ notice = 100% of the total cost, plus any costs already paid to third party suppliers.

    4. Moving any confirmed booking to a different date, could incur additional charges.

  10. Guerilla Projections

    1. “Guerilla Projection” means projecting without the prior consent of the land owners..

    2. Projections will be stopped if:

      1. The police or security guards request us to.

      2. The team feel threatened by members of the public

    3. Depending on the circumstances, we will move to a new location.

    4. We are projectionists not activists and do not want to be the face of campaigns.

    5. Content and location(s) should be agreed 7 days before the projection night.

  11. Guerrilla Street Media

    1. “Guerilla” installations means installing media without the prior consent of the land owners.

      1. This includes all floor stencils, floor stickers, bike frame adverts, posters and street art.

      2. If requested to do so, a fee of 35% of the total installation fee will be required to remove any media of. a campaign unless a specific agreement has been made in writing.

      3. Content and location(s) should be agreed 7 days before the installation date.
